Chisale remanded to prison for another 7 more days

Chief Resident Magistrate Simeon Mdeza of the Blantyre Registry has ordered Paulosi Norman Chisale, head of security for former president Peter Mutharika, to be  remanded at Chichiri prison for seven more days on his attempted murder case after an application by the State.

Mdeza  who presided over the matter  has ordered the Director of Public Prosecutions to commit Chisale to the High Court, failing which, the Magistrate’s Court will review his remand.

Chisale’s lawyer Chancy Gondwe said case should not proceed because the victim of the shooting incident  withdrew the case at Soche Police.

Gondwe has described the process as unfair, indicating that his client can not be detained without trial, adding that he will still apply for bail.

Chisale is facing other two charges of fraud and money laundering.

Allegations against him were that “during the years 2018 and 2019 in the City of Lilongwe, by deceit or other fraudulent means, imported 800 000 bags of cement without paying duty, thereby causing a pecuniary detriment of  5 billion Malawi Kwacha to the Government of Malawi.”

  3. Malawi will not benefit anything if Chisale gets infected by Corona virus in prison and die.
    Prisons are deemed to be hot spots for spreading Corona virus.
    Chisale is innocent until proved otherwise by a ligitimate court. No one should start serving prison term before appearing in court. That is travesity of justice.
    Give Chisale bail and let him appear in court.
    Even most wicked people have their human rights and we cannot start torturing them in that Manner.

    Revenge politics demonstrates the opposite of civilization.
    Give Chisale his right to defend himself in court
    as opposed to inhuman treatment in prison.
    I fail to understand this case as attempted murder.
    For murder there has to be malice aforethought!
    The prosecution have you got enough evidence to prove Chisale’s malice aforethought against the woman whom he did not even know, a woman who just found herself at a wrong place and a wrong time.

    1. Chisilu chimechi should rot in prison. He stole a lot of money. And he discharged firearm in public which is against the law. Shooting the lady is a separate crime from discharging the weapon in public. Shooting in public aimlessly and recklessly are a felony that carries five to eight years in prison. Accidentally shooting unsuspecting citizen is attempted third degree ‘involuntary’ manslaughter. The state has discretion over it. It’s not up to the victim to force the case from going forward. Learn & read your law books.

      How did the Mzimayi close the case .Was it in court or outside court?. Was it deemed criminal case or civil case?
      What does the law say, Is the law allowing such detentions?
