Judiciary spokesperson Mlenga Mvula confirmed Judge Michael Mtambo threw  out the application for Kasambara and two of his jail mates in the conspiracy to murder case because there are no special grounds to warrant bail pending appeal of the case to the Supreme Court.

“The juidge said there are no unusual circumstances to warrant bail for the convicted, they have no special grounds to be considered for bail pending for the appeal,” he said.

A once high flying lawyer Kasambara was jailed for 13 years for conspiracy to murder former Budget Director Paul Mphwiyo, an incident which triggered the K30 billion cashgate, the plunder of public resources at Capital Hill.

Kasambara’s co accused MacDonald Kumwembe and Pika Manondo were jailed to 15 years and 11 years each.

The judge noted there is no likelihood that the appeal will succeed.

Judiciaty sources indicate that the appeal will be heard in the Supreme Court of Malawi by next year .

  1. “The judge noted there is no likelihood that the appeal will succeed.” Oh no, that’s a condescending tone not befitting of a lawyer. It’s like even judges at the supreme court cannot overturn that because they think no better than Mtambo.

Please lawyers challenge this man. We also participated in the 1993 referendum with all our strength to ensure no one man abuses anothers freedoms.

  3. Nambewe, I know that there is one Supreme judge over human beings. Mind you this Supreme judge uses people to punish others. He can use anybody regardless of his blemish. I will give you an example. When the Israel sinned against God, He used the Babylonians who were not God fearing people to punish them. God has His own way of teaching people some lessons in life.

  4. Kikikiki. The police man is wearing a “Stab Proof Vest”.
Nde nanga ikayamba ya mifuti? Alimba?

  5. Kasambara is reaping what he sowed. Remember, God can not be mocked. A man reaps what he sows. Kasambara has done a lot harms to people in this nation. For example: Kasambara assisted his mafia friend who was a pastor then to destroy one of the Evangelical Churches in Malawi. His friend is now a member of parliament representing a constituency in NU. We have been praying to God that He should protect His church by fighting those who stupidly think they are bigger, smarter than God. Kasambara must repent first, then should ask God to keep him healthy until he finishes his 14 year jail sentence. After 14 years he should become a preacher for the rest of his life. Then it will be well with him.
Malawi needs judges of Mtambo calibre for it to move forward as far as justice is concerned.

      1. Infact Kasambara should die in prison. The nation don’t need these thieves. Police takonzani ka ntonga kameneka

    1. OMEX70 you and Mtambo are not God. You cannot judge. there is one supreme Judge over human beings. Mtambo naye lake latsala pang’ono. MK50 million nde wadya, nayonso izayakhula, watch this space

  6. “The judge noted there is no likelihood that the appeal will succeed.” What tosh! So he is the only one who understands and interprets the law in Malawi accurately?

    Akamati atumbuka ndiodzimva sanama.

      1. The name Mtambo is tumbuka. Not all tumbukas are from the north. Some have their mothers from elsewhere. Use your brain to think, man!

  7. I think if all the judges were clear as Mtambo, there would be no cashgate in Malawi. Judge Mtambo for Chief Justice

  8. so the judge says does not believe the appeal will succeed? mmmmmmmmmmmmmmmmmmmmmmm what does this mean to justice?

  9. Next time a lawyer particularly of tumbuka tribe messes with the law, give him a real tough sentence.

What Mtambo is doing here is not justice, but he has forgotten one thing: padziko pano palibebo shasha!

Kuti komwe appeal hearing inatengapo chaka chathunthu?

  10. Ndiye mukuti Hon Kasambara Christmas adyera ku ndende. A Mtambo, please mu mvereni chisoni mzanu. You have already proved kuti you are bigger and smarter than Kasambara. Don’t treat your fellow lawyer as an animal

    1. This Mtambo judge is fantastic! If Malawi had a few of these who practice law as it is meant to, Malawi would be a better place.Which university did he go to?
