Domestic violence case withdrawals worry judiciary
Judiciary officials have expressed concern at the speed women assaulted by their husbands are withdrawing cases.
Spokesman of the judiciary Mlenga Mvula said it was a matter of concern that the women withdraw the cases at the end of the trial just before sentence is pronounced.
“This leaves the court in a fix because as court we believe in fair hearing so if the complainant withdraws the case during mitigation we have no option,” he said.
He said most women ask for the wirthdraw of the cases because they fear if the husband, the bread winner is jailed then the family will be in grinding poverty.
Mlenga described this as a big challenge saying the women sue their husbands on good grounds.
Minister of Gender Patricia Kaliati is on record saying her ministry will push for a law that will make it impossible for a complainant to withdraw domestic violence case from any court.
She said poverty should not be a reason for letting offending husbands with impunity.
