FDH bank CEO Mpinganjira in court for contempt

FDH Bank Limited chief executive officer  Thom Mpinganjira expected to appear in court next month for contempt of court  under Civil Cause number 681 of 2013 between the bank and Maranatha Girls Academy Limited.

Mpinganjira: Refuses to sign court notice

Mpinganjira and  FDH head of credit Tiwonge Khoje are accused of  “contemptuously disobeying” two court orders on the long-drawn casw with the Academy.

The bank is supposed to make a payment of K784 830 909.16 (about $1.2million) due to Maranatha Girls Academy Limited as compensation for loss and damage arising from a breach of three months statutory notice by FDH Bank.

Court documents show that Maranatha Girls Academy Limited sought declarations on a matter regarding a notice of intention to sell the applicant’s property Title Number South Lunzu 7/45 (Maranatha Girls Academy Limited) advertised in the newspapers on September 17 2013, which the court found to be wrongful and flouting Section 68 of the Registered Land Act.

The court ordered that the registrar should assess general damages arising from the wrong.

The High Court issued a notice order for Mpinganhira to attend court hearing next month but he refused to receive delivery of the notice, according to  lawyer Cassim Chidothe who is representing Maranatha.

Chidothe said he recorded that he served Mpinganjira the court notice and that he is aware of the matter “whether he signs or not.”

Judiciary spokesman Mlenga Mvula confirmed that the matter is coming in court  next month for inter-partes hearing for committal to prison.

Now if courts don’t function then, how could we realize thieves as we have all innocent until proven guilty? I think a malawian court of law can make more sense that you who just go around speculating. Facts please!

    3. No way! You can not commit an offense, rush to a Malawian court and get no apprehension. No! Don’t mislead people here. Malawian courts could not get that far if they could. Initially no one is above the law . That’s why even top government officials or millionaires face the justice administered by our courts. Hope you are aware of recent judicial effects on some high ranking individuals. So the attitude of taking Malawian courts forgranted might lead you to regretting it the way it is happening to someone right now. Facts please other than mare allegations and speculations.

  8. Why is FDH behaving suspiciously? In suspicious circumstances they bought our Malawi Savings Bank and now they are in for contempt of court? Very sad I hope rules of natural justice will apply.   9. Something smells on this issue. Mpinganjira is not FDH Bank as per the Salomon Vs Salomon
    1897 Binding Precent. Refusing to sign court orders is not contempt unless one defies subpoena
    and fails to attend the court. I am not sure how Civil Matter would require CEO to be there if
    Judgement was already meted out by High Court as FDH Bank Ltd appealed. Any way lot of
    details are missing and haters are just taking podium without trying to understand what is here.
    Most Tumbukas hate Mpinganjira yet he employees them lot. Tiwonge Khonje, Sitabene Malange,
    Soubuza Ngwenya, Mbachwaza Lungu, Nhlema chief dealer and so many of them. Why such hate?

    1. Chikopa, Don’t talk of closing Adventist hospitals on Sabbath. Even Jesus healed a sick person on Sabbath. The only departments that are closed on Sabbaths are the offices, OPD, Cashier, Pharmacy & others. Labs only open on emergencies but wards are always open to attend to the sick as patients are always there on Sabbath & attend to emergencies. It’s not about money but saving lives

  13. when you think you can abuse justice, justice abuses you. The whole CEO for a bank for that matter failing to appreciate the role courts play in an economy, shame. Investments in an economy can’t survive without general respect for the courts in regard to law and order.
