Law professor says Ansah has left ‘horrible legacy’ at Malawi pollster

A legal expert has given a brutal assessment of the outgoing Malawi Electoral Commission (MEC) chairperson Jane Ansah, describing her as a disgrace to the legal profession differing with President Peter Mutharika who described her as “a distinguished Malawian patriot who has served her country well and selflessly.”

Garton Kamchezera, a law professor at Chancellor College, a constituent college of the University of Malawi (Unima),  has said in quotes reported by the  daily newspaper that Ansah had been an embarrassment as a legal practitioner.

“Malawians should not take anything from her seriously. Young people should not look forward to her as a model. She has been a disgrace to the legal profession,” said Kamchezera.

He said Ansah is leaving a very horrible legacy.

“She will be remembered as incompetent and as causing chaos and as maybe colluding or wanting to help certain politicians to remain in power at whatever cost,” he said.

Kamchezera said Ansah will also be remembered as someone callous in the regard that she did not think about the interest of Malawians.

“From the perspective of the legal profession, as the Malawi Supreme Court put it, an embarrassing inepter with regard to her understanding of the law,” he said.

In an interview with Nyasa Times, social and governance commentator Makhumbo Munthali said Kamchezera is just being diplomatic  in his language on the legacy of Ansah “that is if the events that have characterised the country for the past  year are anything to go by.”

Munthali said: “Truth be told, Ansah is a tragedy of our time.”

President Mutharika has since informed the Judicial Service Commission to start the process of selecting Ansah’s replacement.

  1. I know Garton Kamchezera as a respected fellow with a quite disposition. I totally disagree with some of the comments he has expressed and the way he has expressed them but I will defend his right to say them whenever and however he wants to do so.

    1. I do not see anything to disagree with the genuine Prof! Both Mutharika and Jane Ansah have no understanding of the laws of the land, much less respect for them!!! I know for a fact that Mutharika is not a serious academic,you can check if he has any serious academic output!!!

  2. Do we really need a Judge to chair MEC? In my opinion, my answer is no. We just need someone who is a very good Administrator who understands the constitution, the policies and who can interogate the operating procedures to ensure they enable the process to get the intended result. We need such a person who can critique the process flow driven by the procedures to ensure there are no any risks involved. Where risks prevail, he/she should be able to mitigate them transparently and if need be, make the required changes without deviating from the constitution. How many judges have struggled to manage this institution? We had Hanjahanja, Mbendera now Ansah who were all excellent judges before they came to MEC to be dented by a job that is not part of their expertise. Some will disagree implying that Justice Msosa did well, yes she may be presumed to have left an incorrect process which all who came after her followed it blindedly. It is therefore wrong to criticize Jane Ansah for a job that is not best suited for a Judge.

For your information I have worked at the commisiion for 20 yearsand if thereis any elections that was transparent, this was the one run by Jane Ansah

May be between the differing opinions of these two Professors of Law (Garton and Peter), one of them is right and obviously the other one should be wrong and as for the rest of us, depending on our personal views we are at liberty to choose to side with the right or wrong side. It looks that the total number of twelve judges ( Concourt and Supreme) may be deemed to be on the side of Garton. Good luck!

  7. Surely, Malawi should look into how Attorney Generals are appointed:

    1. One now a convicted criminal on bail
    2. The current one seems to have a lot of credibility issues
    3. The one being discussed in the article above…..well, self explanatory

    There are plenty lawyers in Malawi who can do this job brilliantly – do they attend an interview to be selected?

    Our country has been stagnant for quite a long time due to the habitof tolerating nonsense
    It takes people in the calibre of Chilima, .Mtambo and this law Pro~Kamchedzera to iron out these rubbish, once and for all.
    After all, Pro Kamchedzera is a bona fide citizen entitled to clean his country.

Just because the Presidential elections were unulled makes her a bad person, no how about the Parliamentary and Counsellors elections, if they were conducted fairly, to a person who is sane, nobody unless insanity is in him can rebuke the entire process. In fact, do not argue with a fool, people will notice the difference. In this case, Ansah should not respond and GK should be the fool. In all fairness, as a fellow professional, its not proper to judge your colleague, but rather keep quiet if u r to remain professional.

  22. There are always fools that analyse the achievements of greater men. These fools are never remembered. Jane Ansah will be judged by history. She did her job,the future will tell the story. History is written by the victors so let’s wait and see but truth is she is already in the history books. These fools are not.

  29. We look at her as a role model because we know that she has been demonised just because Chakwera and Chilima want power. If Jane Ansah was a disgrace the courts would have annulled ALL the elections including the parliamentary and local government results.

    1. The courts work with what is presented to them only. They dont act on hearsay or generalisation. Pasakumveka ndi pati kodi? They cannot nullify parliamentary and local government elections as if the petitioners asked for that. odandaula anali ma presidential candidates and they complained on what concerned them. Winanso akakadandaula za ma MP kuti sizinayende, and bring their evidence, the courts will only focus on that. I’m sure you have followed court cases for some MPs from the 2019 elections. One of them anagamula kuti null and void basing on evidence brought in by aspirant MP against declared MP. Not basing or comparing on presidential result in that constituency. Kumamvetsela bwinobwino zigamulozi. Jane Ansah messed up big time

Take a look at yourself in the mirror My Garton, and ask yourself whether you should have published that story that attacks what a fellow legal professional like you (and a judge of Supreme Courto f Malawi), a fellow citizen and ordinary Malawian does as that person’s job, for a living.
