Malawi cannot be ruled by court, says Chimulirenji: Ntaba hits at Judicial ambush on 50%+1
Minister Everton Chimulirenji, who was the de-facto Vice President of Malawi from May 2019 to February 2020, took a swipe at the judiciary claiming that they have hijacked democracy.
The Constitutional Court stunned Malawians on February 3 2020 when it annulled the May 2019 vote that returned President Peter Mutharika to power as president with Chimulirenji as his deputy. The court cited “widespread, systematic and grave” irregularities, which included results sheets with sections blotted out or altered with correction fluid.
It ordered that Malawi should hold a presidential vote within 150 days, a judgement which was this month upheld by Malawi Supreme Court of Appeal.
Chimulirenji in his address at a televised rally at Masintha Ground in Lilongwe which was addressed by Mutharika’s running mate in the 23 June fresh election, Atupele Muluzi, said opposition are rushing to court to hijack democracy by remote controlling the affairs of the State with gag orders.
“The country cannot be ruled by courts. They interpret the law.
“Nowhere in the world is one branch of government allowed to override other branches, here in Malawi that is the case,” he said.
Chimulirenji said that Malawi has defacto become a State in which the judiciary is usurping authority of other branches.
He also laughed at the reasoning of the judiciary which penalised Mutharika, DPP and him for a crime they did not commit- when both the Constitutional Court and Supreme Ciurt in their judgement said there was no rigging of the elections.
“Even in traditional courts, such a miscarriage of justice is not permissible. You can’t go to a village court and be exonerated of your charge yet get ordered to pay a fine,” said Chimulirenji.
Chimulirenji also made an attack targeted the country’s stranged vice-president Saulos Chilima, saying he will do all the political stunts but in vain.
“Chaka chatha ankapanga zodumphadumpha pa nsanja, chaka chino ndiye akuheda matumba. Komabe sawina [in last elections you pulls stunts of push ups and now you are carrying bags of fertiliser but that won;t yield anything ,” said Chimulirenji.
Speaking earlier, presidential aide and one fo the founders of DPP, the famed ‘Talking computer’ Dr Hetherwick Ntaba particularly faulted the Constitutional Court that nullified last year’s poll on its interpretation of Section 80 (1) of the Constitution, saying the framers of the republican constitution did not mean 50%+1 when they said a President should be elected by the majority.
“I was part of the framers (of the Constitution) and we did not provide for 50%+1. On 25 February 1995, I was part of the Committee that was set up to clarify what the section means and at a conference, it was made clear that ‘majority’ in the section meant ‘first-past-the-post,” Ntaba said.
He also said the courts did not find any evidence of rigging yet they went ahead to nullify the election, it does not make sense.”

Dpp is a party formed by Mutharika. UDF is a party formed by Bakili Muluzi. Bingu Mutharika is elder brother of Peter Mutharika. Atupele Muluzi is son of Bakili Muluzi. This means that the Mutharika and Muluzi families are dominant in Malawi politics.
Should Malawi politics be dominated by these two families as if there are no clever politicians in Malawi?
The very people who have stolen money from our previous government’s in the past making Malawi to remain underdeveloped in this part of the world.
The old politics of keeping Malawi poor always so the people should remain beggars every year.The majority of Malawians are left destitute and these UDF and DPP parties enjoy giving handouts to the poor using tax payers money so that they should look as if they are a caring party/government. Politics of giving handouts should be banned. People should be able to fend for themselves not depending on handouts.
Muluzi and Mutharika families should be stopped from taking Malawians for the dogs. We want new politics and new leaders.
Chakwera and Chilima combination is the sort of leadership that will bring hope and prosperity to Malawi.
In DPP/UDF there no leadership qualities to develop Malawi.
Mutharika is too old and frail.He is 80 years old and he has no energy to develop a country like Malawi that lacks social and economic infrastructure to be able to satisfy the youthful generation that lacks jobs and better education facilities.
Mutharika is too old and needs to retire from politics. We need a young leader to take Malawi forward.
Hetherwick Ntaba is useless and empty headed person. He is not a lawyer. He is just a mere doctor. He is out of touch and he is not a political asset. He has no value.No credible political party in Malawi would want to associate with him. He was Dr Hastings Banda personal doctor. He is failure in life. He was a DJ a few years ago before he chanced into politics. Nothing but an empty bucket.Good at making noise.
For those of us who are old enough we know the following facts:
Malawi Congress Party was the only legal party before 1993 referendum whose President was Dr Hastings Banda
Secretary General and Administrative Secretary was Bakili Muluzi.
Dr Hetherwick Ntaba was personal physician or doctor of Dr Kamuzu Banda.
Nicholas Dausi was a Malawi Young Pioneers and Spearhead operative of Malawi Congress Party.
Bakili Muluzi was arrested for stealing £6 .
Currently Bakili Muluzi is on police bail for stealing government money £1.5 billion and the case is in court with ACB prosecution.
Hetherwick Ntaba is a useless person and his political life is past out of date. He is not relevant today he is calling young baby Atupele Muluzi as “bwana” how stupid and low can he go at the moment. Where is he heading to and what does he want to achieve in this day and age. He is useless man.
Another useless men are Cassim Chilumpha and Brown Mpinganjira. They know that their political lives and usefulness in contemporary politics is not relevant and yet they continue to force themselves among the new generation of youthful politicians.
I suggest all these old confused and irrelevant politicians over 70years of age should be banned from active politics. Names like Bakili Muluzi.,Hetherwick Ntaba and Brown Mpinganjira and Cassim Chilumpha must be banned from contemporary politics forever.

Ntaba’s message is aimed at the illiterate who , unfortunately, make up a majority of the population. The matter in court was not about rigging, it was about mismanagement of the electoral process by MEC where your master and your party were beneficiaries of that mismanagement. Chakwera and Chilima proved in court that the election was handled incompetently, hence its annulment. So, since the election was annuled, everything that came as a result of it had to be cancelled, meaning that there was no winner and no loser. That is why the previous office holders had to continue to hold office until a proper election is conducted. That in turn meant Mutharika and Chilima back in their positions.
As for Chimulirenji, he is simply crying for a post that was never his. Muzingoyamika kuti munayeserapo kukhalapo. Listen Mr Chimulirenji, the courts are not ruling this country, they are simply deciding who is right and who is wrong. You and your team has been found to be wrong in everything that has been done. You know why? You thought you were supreme so you went about doing all the wrong things believing that you were untouchable. Now it’s time for you to learn that you ca cheat some of the people some of the time but you can not cheat all the people all the time. We are waiting to have the last laugh come polling day. Are we clear?
Dr. Ntaba, you might have been there in 1995, but that does not mean if things were wrong we should kept the status quo.

Seriously speaking, DPP should ease off on insulting the judiciary. Just as many people only appreciate the presence of God when they recover from a serious illness, so too do Malawian politicians really appreciate the usefulness of the judiciary only when they are in opposition. Not too long from now, DPP will no longer be a “ruling” party and they will be running to these same judges to shield them from Tonse Alliance investigations. A little respect for the judges now would not be a bad idea. Believe it or not, you are going to need them…

Do you know why dpp was popular between 2005 and 2009? It’s because Bingu dumped the party that terrorized Malawians for 10 years and arrested it’s notorious leader Bakili Muluzi for corruption though he too terrorized Malawians and killed 21 on 20 July 2011. His death was received with mixed reaction and those who didn’t celebrate his death did that because it is against our culture to celebrate death of someone. People of Malawi are forgiving and forgave Bingu and gave his brother a benefit of doubt. Alas! Another monster who has brought back udf or who has handed back dpp to the notorious Muluzi family. APM doesn’t care and sees no reason to care because he is dying and his family is no longer in Malawi. There is no dpp in Dowa, Ntchisi, Kasungu, Dedza, Salima etc. Peter you have to know that people don’t like the Muluzi family. Bakili is fortune because he is a Muslim as such he will be buried within hours of his death. If he were a Christian surely the family would hire fellowship worshipers to pray at his funeral. Why have you handed back dpp to udf. Another thing that we did not like APM is tribalism. He has kept other tribes in subjection. Chimulirenji is not making a mistake. He is speaking his opinion on the judiciary just like all we have out opinion on the President, opinion on the Parliament. The Judiciary has entered the political fray, they will get to hear different peoples opinions on them and it will not be always in their favour and they will receive intense scrutiny. They have began determining the winners of the elections. In other forums and groupings where these judges are members they were openly getting encouragement from the groupings for the overturning of the elections and now are being celebrated as heroes, is that judicial independence?

The judges were making their cases and ruling on them.we know Nyirenda Chilima and Chakwera had been meeting to strategize on how to go about the case and the MK9 billion that they are charging MEC will be divided between The judges, the lawyers and the petetioners. This was a syndicate. Otherwise the sensible thing to do was to ask each party to be responsible of its costs.
