Man 42, gets 10 years jail for sex assault on teengirl

First Grade Magistrate Court at Chintheche in Nkhata Bay District has sentenced a 42-year-old man to 10 years Imprisonment with Hard Labour (IHL) for defiling his neighbour’s 13-year-old daughter.

The court heard that on 30th September this year at around 9 o’clock in the morning, Nyoloka Banda grabbed the victim to a nearby bush while she was coming from a well and defiled her. In turn, Banda gave the victim a K100 bank note for her to conceal the incident.

However, the girl’s parents were surprised with Banda’s conduct who also gave the victim some fish upon arrival at home.

When parents quizzed the girl why Banda was unusually kind to her on the day, she revealed that Banda gave her money and the fish to conceal the defilement.

The girl’s parents reported the matter to police who later arrested Banda. A medical report from Chintheche Rural Hospital confirmed that defilement.

Appearing before the First Grade Magistrate Court at Chintheche, Banda pleaded guilty to the offence and was consequently convicted.

In mitigation, he asked the court to give him a lenient sentence saying it was his impeccable love for the girl that led him into the dock answering the defilement charge.

However, State Prosecutor Sergeant Ephraim Njewa asked the court for a stiffer penalty to deter other would-be-offenders.

He argued that Banda’s action was capable of destroying the girl’s future as it could lead to pregnancy thereby preventing her from continuing with her education.

Passing judgment, First Grade Magistrate Alexander Gomba lamented that such cases are on the increase. He, therefore, sentenced the convict to 10 years IHL, to serve as a lesson to other would-be-offenders.

Banda hails from Mtambwa Village in Traditional Authority Fukamapiri in Nkhata Bay District.
