Parliament, UDF say MP Kaliati must face the law in underage sex offence

Parliament’s legal affairs committee has said arrested UDF MP Shaibu Kaliati should face the law if court proves that he had sex with a minor.

The committee’s deputy chairman Maxwell Thyolera said if the court proves that Kaliati indeed had sex with the 16 year old from Bambino Private Secondary School, it would be unfortunate saying Kaliati was instrumental in passing the child protection law.

Kaliati was arrested on Friday for allegedly sleeping with the minor at Annes Lodge in Lilongwe.

Reports say he disappeared from parliament during tea break and allegedly gave the minor K6000.

He was detained at Lilongwe police station but has since been transferred to Lingadzi police station in Lilongwe.

The United Democratic Front chief whip in parliament Lilian Patel said she was shocked to learn of the arrest and said the party would respect the decision of the court.

She said the party cannot condone such behaviour if proved in the court.

“As a party we are looking for his lawyer and providing food for him in his detention,” said Patel.

Members of parliament are exempted by law from arrest when parliament is in session and his arrest shows the gravity of the offence.

Kaliati has confirmed that police are investigating rumours alleging that he had sex with an underage girl.

  5. I thought this is our constitution and laws that a girl can marry at 16 years. When you legalized that a girl can marry at 16 years, what were you expecting she will be doing with the partner or spouse? Kusewera phada? Is not sex you are now arresting this honourable MP? You wanted him to go ask for consent from the parents or guardians to sleep with her? By allowing a girl to marry at 16, you legally accepted them to start sex. Please release this guy and he did not commit any crime. Only that Law enforcers have hangover of outdated laws!

Kodi mwati a bwanawa apalamulanji? the laws of malawi says a girl under 16 can be defiled. it means if the girl was 16 or above on the day the act took place and she consented then there is no defilement. please educate us on the law used to arrest the mp. if it is the child protection act then it has to battle with the constitution coz it allows a 15 yr old to get married. am not backing the mp but thats what the law is.

  50. His arrest is illegal if the law is to be followe(section 60 of the constitution)d. Also a 16 year old girl is not underage by law. If she was less than 16 then it would be crime but the fact that she is 16 and gave her consent(received money) mlandu palibe.just release him.

    How do you prove that? He is likely to say he took her to the lodge, touched her breasts and did not penetrate…..that will be the end of the case.

  80. Bravo police. We don’t want savages in our parliament who pass the law and become hypocrites of the same. Who will abuse his children. I urge the state to engage the Director of Public Prosecution to handle the matter. There may be a technical loophole in the case on corroboration of evidence since the child might have already taken a bath which may be impossible to prove penetration. So we need expert team to handle the matter and not the police. Defence lawyer will easily twist your your evidence and reasoning and lose the case. Where is this lawyer for ministry of Gender. Akweni, please team up with your fellow women in this cause. MPs need to be exemplary. The law is not for the poor and marginalized population. Shaibu must face his own make up. The presiding magistrate must also be very serious in adjudicating this case. It is of both high profile and sensitive since it has been committed by the legislator. My view is that sentecing must be done by the High court.
