Uladi says not even courts have powers to question minister over passport issuance

Former Homeland Security minister Uladi Mussa has told the High Court in Lilongwe that no one, not even the courts have powers to question why and how a minister’s decision to approve or reject an application for citizenship.

Uladi Mussa: Defending himself as court found him with a case to answer

Mussa said this on Tuesday as the state continued to accuse him of dubiously granting Malawian passports and citizenships to over 50 foreigners between 2013 and 2014.

“Section 29 of the Citizenship Act protects the minister from saying why and how he arrived at the decision,” he said.

But Kamudoni Nyasulu, a special lawyer hired by the state to prosecute the case, told Mussa and the court that the former presidential aide disregarded all recommendations made to him by the principal secretary.

Nyasulu showed the court some communications between the principal secretary and the former minister which showed the PS had recommended one thing but the former minister acted differently.

This was brought to surface after Mussa said he was only acting on recommendations presented to him by the principal secretary whom he said is conversant with the processes of granting passports and citizenships.

  2. How much Mussa pocketed? Here is the sum

    (a) 1 passport = $10,000 each charged.
    (b) Then 50 passports = (50 x $10,000 ) US Dollar which is = $500,000 US Dollar
    (c) $500,000 x Mk750 exchange rate as of today, then in Malawian Kwacha Mussa pocketed = Mk 375,000 000 . More than 3times what Peter pocketed from Zameer Carim of Mk145million.

    This guy need to pay back the money to Malawians he abused through this passport gate. No need to waste time with him just open a prison gate.

  4. Why do we Africans hate ourselves? Why are we wasting resources prosecuting an Ex minister for issuing passports to fellow Africans who were escaping wars that had rocked their countries. We need to get rid of these colonial laws that separates us (Africans) and eliminate this slavish mentality. An African national should never be a foreigner in Africa.

  5. So the minister has effectively admitted that he did what he is being accused of, save for the fact that Section 29 protects ministers. I hope he realises that he is no longer minister hence that Section 29 no longer applies to him.

  6. Even if Uladi is found guilty, he knows a Dad will grant him presidential pardon and then reward him with another ministerial appointment. That’s how a ‘mafia’ government works. The more you break the law for the benefit of the ‘mafia’ government, the more promotion you get. Just look at the case of honourable Chaponda after ‘maizegate’!

  7. The department has powers to cancel all those documents if they were taken illegally, and that is when you can start casing him . if not there is prove of all requirements to be given to those people then leave has no case to answer.

  11. Mussa automatically qualifies to be at Maula prison, no question about it. His Lawyer is one of the street Lawyers like Bob Chimkango and Frank Mbeta. They believe in judge shopping and cannot win a case based on factual arguments.
