Muluzi case out of High Court: Malawi ex-president matter taken for review at Constitutional Court
The High Court in Malawi has committed the K1.7 billion graft case involving former president Bakili Muluzi to the Constitutional Court for review, a move regarded as steps to dismiss the matter.
In 2011 Muluzi and his co-accused Lyness Whiskey applied to have the case shifted to the Constitutional Court but the application was voluntarily withdrawn.
Muluzi lawyers filed a fresh application in September 2016 to transfer the 10-year-old criminal case to the Constitutional Court, arguing it was a highly politically matter that needs to be heard before a panel of three judges.
Judiciary spokesperson Mlenga Mvula confirmed Judge Maclean Kamwambe referred the matter to a panel of three judges at the Constitutional Court..
“The case has gone for review after Chief Justice certified that the case should be referred to the Constitutional court,” said Mvula.
He said Justice Kamwambe just read out what Chief Justice said.
