Woman jailed 5 years for possessing live ammunition

Rumphi First Grade Magistrate’s Court HAS sentenced a 45-year-old, Baleke Kayira to five years and six months imprisonment with Hard Labour (IHL) for illegal possession of six live ammunitions and a portion of eland meat without a permit.

The  convict was arrested on June 8, 2019 at Gamba area in Chitipa district during a police search operation in communities surrounding Nyika National Park.

Rumphi Police Station prosecution officer, Paul Phiri told the court that

the police recovered six live ammunitions and the portion of eland meat from her.

He said that Kayira was charged with two counts of illegal possession of live ammunitions and specimen of endangered game species contrary to sections 12 (1) of Fire Arms and 86 (1) of National Parks and Wildlife Act respectively.

Kayira pleaded guilty to both counts.

In mitigation, the convict asked for leniency on the basis that she was a first offender.

The state requested for a stiff penalty to teach her a lesson and deter would be offenders from killing protected animal species.

Presiding Magistrate, Cuthbert Phiri sentenced Kayira to five years and six months IHL on the first count and five years on the second count which will run concurrently.

The convict hails from Mwenegamba village in the area of Traditional Authority Nthalire in Chitipa District.

What kind of justice is this? A woman is found with a piece of bush meat and gets 5 years in jail, yet these DPP clowns that are stealing billions don’t even get cautioned by the police?

Atumbuka nkhuli. Eland is a protected animal only found in a protected area. Being found in possession of illegal live ammunition is a a serious offense attracting a 10 year sentence. The court was too linient with this stupid tumbuka woman. Each one of the offenses required 10 years consecutively. The total should have been 20 years to teach other would be tumbuka offenders.

While I don’t support what she did, I feel that sometimes our courts give excessive punishment to those who seem to be poor. We had a woman who was arrested after stealing millions and was only given three years and she didn’t even finish her sentence. We have someone who is alleged to have killed his girlfriend and buried her under a bathtub and was a fugitive for many years, now on bail. Chilungamo ku Malawi chimawona nkope
