Ansah says MEC using old laws to run fresh elections

Embattled Malawi Electoral Commission (MEC) chairperson Jane Ansah is drawing criticisms and stinging attacks after she said the pollster is preparing for the fresh election using the same old laws for the nullified  ‘Tippexed’ May 21, 2019 election.

Ansah said this on FrIday  in Blantyre during the National Elections Consultative Forum (Necof) meeting.

“We are preparing for the fresh elections using the same old legal frameworks that were used during the 2019 nullified elections since the parliament amended electoral bills are yet to be made laws,” she said.

On majority representation, Ansah has told political party representatives and other electoral stakeholders that the current law does not allow for a runoff, making it confusing on how to declare winner in the fresh election.

She also said MEC will accept all proofs of identification under the current law during the voter registration because President Peter Mutharika is yet to assent to the electoral reform bills.

Meanwhile, Ansah has told NECOF meeting in Blantyre the commission will respect the Constitutional Court ruling to hold fresh elections within 150 days.

  5. What is the she devil Mary Nkosi doing in the commission, I thought she had resigned. There is no way MEC would use an act of parliament before the constitution is amended. The useless ruling was put before law students at the University of Land on, law faculty and all students laughed at this judgement of a sample of a useless ruling only fit to be done by judges who were sleeping on duty

  7. What you must know is that even after the concort had recommended Parliament to discuss 50+1, the Parliament rejected the 50+1 and the motion was thrown out. So we are back to simple majority. This is where the opposition gets a real-time nyekhwe.

  11. Jane Ansah is just very right. Even a lay person can understand her arguments. The Malawi constitution for our Presidential election still stands as it is and it must be respected. Compounding to that is the fact that Parliament did not approve the 50+1 way of selecting our Presidents. The Hansard has all those records. The three Arms of government are independent and all have powers vested in them. No single Arm of government is superior to the other. As such, the Judiciary has no powers to force the Legislature into implementing anything which Judiciary dreams fit. Jane Ansah is therefore 100% right

    1. Don’t mislead people here. She is right on the point that the bills have not yet been signed by the docile president, therefore, her argument of using the old legal framework is correct. You are wrong on the point of 50%+1. This is one of the bills that the tipex president needs to sign as well.

Your understanding of the Constitution seems suspect because the principle of checks and balances actually does allow, for example, the Judiciary to review the manner in which the Parliament or the Executive are performing their duties for compliance with the Constitution!! So the Parliament or Executive can not invoke ‘parliamentary privilege’ or ‘separation of powers’ to perpetuate violation(s) of the Constitution!!! Many of you need a refresher on the Constitution, along with Ansah and Mutharika!!

  12. Con Court ruling is very clear about the 50 + 1, anyone who amass votes that are less than 50+1 should not be declared Winner, else it will be contested again in court, so where are you understanding here madam Ansah?

Mai Ansa what you have to know is that using old laws in this fres election is contempt of court. on 3rd Feb 2020 our ConCourt ruled out the old laws to be replaced by the news which mr president is refusing to sign. he is refusing to sign because he knows the moment he signs then it is also firing you. You, DPP, mr president you are fight with the law. you are fighting with people’s right of choice. you are not ethical in everything. when people say they found you incompetent, these are some of the things that back them. Can you put the house in older please.
    Are you the only one to run the elections, don’t we people in Malawi to do the job you are doing now. Please step down we want progress in our country we don’t want you to be talking about elections as if you are an expert in handling issues connected to the constitutionand yet every day you break the law.
