ACB wants Judge Kenyatta, Attorney General, DPP out of former IGs corruption case Inbox
The Anti-Corruption Bureau (ACB) has applied for the recusal of High Court Judge Kenyatta Nyirenda as well as the removal of the Attorney General and the Director of Public Prosecution (DPP) from a corruption case involving former Inspector General of Police George Kainja.
Kainja was arrested some two months ago in relation to businessman Sattar corruption case in which the United Kingdom is prosecuting the businessman over various contracts which were awarded to him by the government of Malawi.
However, the former IG is challenging his arrest arguing that it was effected using information obtained illegally from a foreign agency, the UK’s National Anti-Corruption Agency.
The Bureau has argued that Judge Nyirenda is one of those mentioned in the Sattar leaked phone conversation that he was one of the beneficiaries of the businessman’s corrupt activities.
On the other hand the Bureau argues that the AG and the DPP have no relevance to the proceedings.
When the matter came before Judge Nyirenda on Friday morning the ACB made the two application through preliminary objections among others arguing the the presiding Judge is an interested party.
Meanwhile, Judge Nyirenda has set October 3 as the date he will deliver his ruling on the two applications.
Lawyer for Kainja, Gift Nankhuni has refused to comment on the matter saying he will wait for the court’s determination.
