Attorney General warns HRDC against demos, says court contempt

Attorney General Kalekeni Kaphale has warned Human Rights Defenders Coalition (HRDC) to suspended their peaceful protests tomorrow, saying going ahead with the demos would be contempt of court.

Kaphale: Pens HRDC

In a letter to HRDC lawyers, Kaphale says instead, HRDC officials should go to court and meet the judge who gave the 14-day moratorium on protests.

“The parties failed to meet the judge within the 14 days or immediately after the expiry thereof as the judge was reportedly out of jurisdiction.

“The judge is now back and has given the parties the 20th September, 2019 to attend before him,” says the letter in part.

The attorney general says the government therefore does not HRDC to hold the protests from Wednesday until the judge makes his final orders.

“…(government) will consider any such demonstrations as being held in contempt of court and will seek appropriate court orders against the conveners and participants,” says the letter.

But lawyer for HRDC Khwima Chizi said the issue of the 14 days was very clear in the court order, saying HRDC is acting within the law.

He blamed the government for the failure of the two warring parties to sign a consent agreement.

It is not the attorney general who was supposed to be concerned with contempt but the court

But you have not told me what I asked. I asked whether the only assignments of HRDC is to organize Demos, not what tribe I belong. By asking means I am not aware of what they do. Is that wrong? I thought I am a Malawian with the RIGHT to know. So why are opening up of you garbage heaping in your head. By the way it appears Alomwe think better than you Tuvitwana, and I do not know what tribe you are from. But one can tell, hate, kutukwana, and I am sure your parents where ever they are,… Read more »

Kaphale is a laughing stock, did he think that he could play delaying tactics and buy time in the process forever? How on earth could that be? Why did the judge disappear within those crucial 14 days?

Hrdc is the worst NGO ever I wonder what kind of office they run.

The media is also in fanning the flames just to make money. I just listened to the demos advert jingle on zodiak….so full of incitement. Today they are promoting the demos and tomorrow they will be reporting the resulting damage in order to inform the nation. Literally no ethics only money making in their minds.

This is why demos were put in the constitution so that people must demonstrate when not happy. Be home if you can’t facentre them.

Kaphale u think u are clever than all our judges. That they should crap hands for you, that they should be dancing to your tunes, that u should have power to close their eyes, that you should tell them what to do, that u should tell show them how to proceed with cases, that you should tell them when to grant injunctions and when not, that u should school them about the constitution as if they don’t know, that you should offer them money to defeat justice.
I rest my case
