Law professor accuses MEC over contradictions

A prominent law professor has accused the Malawi Electoral Commission (MEC) of double standards and contradictions after hiring South African lawyers for the election case when it says it has no money for the polls.

Kamchedzera : MEC cannot see the contradiction themselves because they are blinded with their fight against the Constitutional Court ruling

Government has hired the foreign lawyers to handle the elections appeal case at a staggering fee of K600 million.

Ironically, some of the grounds for the appeal is that the pollster has no money to hold the Constitutional Court sanctioned fresh election.

But  Garton Kamchedzera, a professor of law at Chancellor College, a constituent college of the University of Malawi, said the hiring of the foreign lawyers at such a fee is a clear indication that the government has money for the elections.

“They said they don’t have the money to run for the election poll because they were simply fighting the Constitutional Court ruling. They did not mean what they said,” he said.

He said MEC cannot see the contradiction themselves because they are blinded with their fight against the Constitutional Court ruling which annulled the May 21, 2019 presidential election and ordered for a fresh poll.

The Professor is contradicting himself.MEC has a running budget for its daily operations thus salaries, fuel, insurance etc. Then there is the Election money which they pegged at K40bn plus to cover every election activity. The K600m for their legal costs is not part of this election money, it is part of the legal costs they are using to pay their legal counsel.

I do not know how much K600 million is? I have never made a million kwacha in my life. But K600 million seems a lot of money. To pay for, say, legal services! Jane Ansah must be a billionaire!

Comrade Simbi said it all, “Nzeru za bankha”. Malawians in rural areas are in untold suffering, most of them have no food and there are no medicines in both our rural and referral hospitals yet our ” DPP Rulers” are spending MK600 million on TipExed appeal case which they can NEVER win. Pali nzeru apa Akumangwetu????

Professor you have hit the nail on the head. MEC has unfortunately resorted to blatant deception and day-light lies in their desperate quest to retain some iota of dignity. It is too late. Malawi will never remain the same after the 3rd February 2020 constitutional court ruling in favour of true social justice. It would take efforts of ‘rocket science’ magnitude and ‘imported’ jurisdiction to return Malawi to pre-3rd February 2020 status quo, which the enemies of progress are doing everything possible to do. Mission impossible!
