Malawi Congress Party (MCP) spokeswoman Dr Jessie Kabwila says the party feel vindicated with the report by the taxpayer-funded Malawi Human Rights Commission (MHRC) on controversial May 20 Tripartite Elections which has questioned the legitimacy of President Peter Mutharika.

MCP has been claiming that Mutharika was ruling through stolen votes but that their party leader Rev Lazarous Chakwera urged them not to react to avoid plunging the nation into turmoil.

Kabwila welcomed the MHRC report; it was a vindication of the MCP and other stakeholders’ positions that the elections “were not credible.”

Said the MCP spokeswoman: “We very much feel vindicated.”

Kabwila said MHRC report also add credence to You Centre for Multi-party Democracy [CMD] report which al indicated that “the election results were not credible.”

She insisted MCP and Chakwera legitimately won the elections but DPP stole their victory.

The outcome of the presidential results was mired in controversy amid allegations of rigging and confusion over how the Malawi Electoral Commission should have proceeded in the wake of conflicting court rulings on vote counting.

The results of the vote were announced on 30 May, minutes after the High Court refused a last-ditch attempt to block their release and allow time for a recount.

The MHRC report launched on Thursday in Lilongwe said the elections that ushered Mutharika to power was lacking fairness, transparency and credibility.

Commissioner Reverend Zac Kawalala told a news conference that the eventual outcome was in dispute and aspects of the report point to questions over Mutharika’s legitimacy “which the public must take note.”

DPP spokesperson and the party’s leader in Parliament Francis Kasaila dismissed MHRC report, saying “more credible institutions declared the results credible, free and fair.”

  23. what about the other reports by international organizations and observers that came up with a contrary conclusion, and secondly conclusions that say free fair credible outnumber this conclusion. How can you then speak of vindication??
    Factually, if you are counting the number of reports that were in MECs favour against those that were not then no credible impartial non – partisan journalist can talk of vindication, its incorrect and does not follow logic!

In actual fact there were some scuffles here and there because the authorities then messed up the whole process by actually not knowing what to do. Just a reminder, “Do you remember that Joyce Banda even wanted the electoral commission to be under the office of the Vice President?” Unfortunately it didn’t work due to external pressure from other sectors of society. How many times did we hear about mid-night meetings held at the state houses between Joyce and the leadership of this very whingeing party? Malawians please let us not behave childlike because of some individuals whose parents were asylum seekers in other countries, for if we are not careful those same people will go back where they came from when the country will start burning. Free, fair, and credible election starts from civic & voter education, voter certificate registration and verification exercises, campaign rallies, actual ballot casting on the election day, vote counting, to results announcement. If people were freely participating in all these without being intimidated or threatened, enough registration and verification period was given to accommodate all people, enough voting period was given to accommodate all people, nobody was denied the right to either of these exercises in line with constitution governing the election, voters had right to ballot secrecy, media participated freely without any blocks neither the media houses were closed on political grounds nor any journalist arrested on political grounds, no any forces used by either police or military on unfounded grounds likely to cause public disorders which inturn harms the voter’s rights, free voting atmosphere, THEN the election is declared free, fair and credible. IN the case of extended voting, delays in opening voting centres, delays in announcing results, errors in counting and aggregation, THESE are challenges or discrepancies which fall between 0-1% of the total election, and are often corrected in the process by all the concerned parties, and after they don’t bring any changes to the whole exercise which claims 99% of the total election. IF MHRC really went through all these steps observing then their REPORT is INCORRECT and lacks some credibility, that’s why it’s has been released seven months after an election. Its motive is to confuse people as it will bring no any changes to the final decision that was reached by of the election governing body of the land in regards to May 20 election. Otherwise the timing of the report is treason in nature.
